1. General provisions
This document establishes the terms and conditions of use for the website www.primemedical.ro, operated by Prime Network SRL, a company registered in Romania.
By accessing and using the website, including placing an order, you expressly accept these terms and conditions in their entirety.
We reserve the right to modify these terms at any time. The updated version will be published on the website, and continued use of the site after publication constitutes acceptance of the changes.

3. Products and prices
All products sold on the website are 100% original, sourced from authorized manufacturers and distributors. Prime Medical is an authorized distributor of medical devices.
Prices displayed on the website include VAT and are expressed in RON. Prices may be modified without prior notice, but the applicable price is the one displayed at the time of order placement.
We make efforts to ensure the accuracy of product information (descriptions, technical specifications, images). However, the presentation of products on the website does not constitute a firm offer within the meaning of the Civil Code.
Product availability is displayed in real time. If a product becomes unavailable after order placement, we will notify you immediately and offer the option of full refund or replacement.
4. Registration and user account
To place an order, you can create a user account or order as a guest. Account creation requires providing truthful and complete personal data.
You are responsible for maintaining the confidentiality of your authentication data (email and password). Any activity performed through your account is your responsibility.
We reserve the right to suspend or delete accounts that violate these terms, provide false information, or are used for fraudulent purposes.
You can request the deletion of your account at any time by contacting us at contact@primemedical.ro. Account deletion also entails the deletion of associated personal data, except those required for legal obligations.
5. Placing and processing orders
Placing an order on the website constitutes an offer from you to purchase the selected products. The sales contract is considered concluded when we confirm the order by email.
After placing the order, you will receive a confirmation email with the order details, including ordered products, total price, and delivery address.
We reserve the right to refuse or cancel an order in justified cases: price errors, unavailable products, fraud suspicion, or exceeding reasonable quantity limits.
Orders are processed in the order received, on business days. Orders placed before 2:00 PM are shipped the same day, subject to stock availability.
6. Payments
We accept the following payment methods: bank card (Visa, Mastercard, Amex) through the secure Stripe processor, Apple Pay, Google Pay, and cash on delivery (cash or card to courier — available only in Romania).
Card payments are processed exclusively through Stripe. We do not store your card data on our servers. All transactions are encrypted and protected by 256-bit SSL protocol.
The tax invoice is automatically generated via SmartBill after payment confirmation and sent by email in PDF format. The invoice can also be downloaded from your account on the site.
For subscriptions, payment is made exclusively by card. The amount is automatically debited at each delivery cycle. You can cancel or modify your subscription at any time from your account.
7. Delivery
Delivery is carried out through the Sameday courier service, both to address (home/office) and through the EasyBox locker network.
We deliver to Romania, Hungary, and Bulgaria. Delivery times are: 1-3 business days in Romania, and 3-5 business days for international deliveries, from the date of shipment.
Shipping costs are transparently displayed on the checkout page before order completion. Delivery may be free depending on the order value, according to the conditions displayed on the website.
The risk of loss or damage to the products passes to the customer when they (or a third party designated by the customer) take physical possession of the goods.
8. Right of withdrawal and return
According to OUG 34/2014, consumers have the right to withdraw from the distance contract within 14 calendar days from the date of receiving the products, without stating any reason.
To exercise the right of withdrawal, open a 'Return' request from the Support section of your account. Products must be returned in original packaging, unused and undamaged.
According to art. 16 (e) of OUG 34/2014, the right of withdrawal does not apply to sealed products that cannot be returned for hygiene or health protection reasons and that have been unsealed after delivery (e.g., applied CGM sensors, unsealed consumables).
Refunds are processed within 14 days of receiving the returned products, using the same payment method used for the purchase. Return shipping costs are borne by the customer, except for defective products.
9. Warranty and conformity
All medical devices sold benefit from the legal warranty of conformity of 2 years according to Directive (EU) 2019/771, transposed into Romanian legislation.
CGM sensors and consumables have warranty for the usage period specified by the manufacturer. Warranty covers manufacturing defects and non-conformities existing at the time of delivery.
To claim warranty, open a 'Warranty' ticket from your account. The product serial number, problem description, and photos of the defect are required.
Warranty does not cover: damage caused by improper use, unauthorized modifications, storage in inadequate conditions, or normal wear of consumables.
10. Subscriptions
The subscription service allows automatic product delivery at regular intervals (monthly, bi-monthly, quarterly), with the possibility of benefiting from discounts compared to the standard price.
Subscriptions work exclusively with card payment. At each cycle, the amount is automatically debited, and the order is processed and shipped according to the subscription schedule.
You can modify the frequency, quantity, or pause/cancel the subscription at any time from your account. Changes apply from the next billing cycle. There are no cancellation fees.
If the automatic payment fails (e.g., expired card, insufficient funds), you will be notified by email. If payment is not regularized within 7 days, the subscription will be automatically suspended.
11. Intellectual property
The entire content of the website (texts, images, graphics, logos, design, software, databases) is the property of Prime Network SRL or its licensors and is protected by copyright and intellectual property legislation.
It is prohibited to copy, reproduce, distribute, modify, or use for any commercial purpose the content of the website without the prior written consent of Prime Network SRL.
The trademarks 'Prime Medical' and 'Prime Network' are the exclusive property of Prime Network SRL. Their unauthorized use constitutes a violation of industrial property rights.
12. Limitation of liability
Prime Network SRL is not liable for: temporary website interruptions due to maintenance, cyber attacks or other force majeure causes; indirect, consequential or incidental losses resulting from the use or inability to use the website.
Our total liability in connection with any order shall not exceed the total amount paid by the customer for that order.
The information displayed on the website regarding products is provided in good faith. However, it does not constitute medical advice. Always consult a healthcare professional before using any device.
We are not liable for the content of third-party websites referenced through links on our website.

14. Dispute resolution
These terms are governed by Romanian legislation. Any dispute shall be subject to the jurisdiction of the competent courts of Bucharest, Romania.

According to OG 38/2015, consumers may resort to alternative dispute resolution (ADR) procedures through the European online dispute resolution (ODR) platform.
15. Final provisions
If any provision of these terms is declared null or unenforceable, it shall not affect the validity of the remaining provisions, which shall remain fully applicable.
The waiver by the Seller of the exercise of any right under these terms does not constitute a waiver of the subsequent exercise of the same right or any other right.
These terms, together with the Privacy Policy, Cookie Policy, and any specific conditions displayed on the website, constitute the entire agreement between you and Prime Network SRL.
